Generally, no. Lower-Tier carrier registrations are strictly for businesses carrying only waste produced by their own normal operations (except construction or demolition waste) or charities. Any commercial business carrying another party's waste or carrying construction waste must hold an Upper-Tier (CBDU) licence.
What is an Annual Season Ticket WTN?
If a business regularly transfers the same type of commercial waste to the exact same carrier over a prolonged period, an annual "season ticket" Waste Transfer Note can be executed covering all transfers for up to 12 months, avoiding individual notes for every collection.
How long must Hazardous Waste Consignment Notes be kept?
While standard non-hazardous Waste Transfer Notes must be retained for 2 years, Hazardous Waste Consignment Notes (under The Hazardous Waste Regulations 2005) must be preserved for strictly 3 years.
Is fly-tipping by a rogue carrier the producer's liability?
Yes. Under Section 34 strict liability, if a business fails to verify that the person taking their waste is an authorised Upper-Tier carrier and the waste is subsequently fly-tipped, the business producer can be prosecuted directly for breach of duty of care, even if they were unaware of the fly-tipping.
